1. About FragSwipe

FragSwipe (“we”, “us”, “the platform”) is an online classifieds marketplace operating at fragswipe.co.za. We provide a platform for individuals to post and discover listings for marine aquarium livestock and equipment in South Africa. By accessing or using FragSwipe, you agree to these Terms of Use.

2. We are a marketplace — not a party to transactions

FragSwipe is a platform only. We are not a buyer, seller, broker, agent, or auctioneer. We do not own, inspect, verify, warrant, or guarantee any listings, items, or the identity or reliability of any user.

All transactions are made directly between buyers and sellers. FragSwipe is not a party to any agreement entered into between users. We have no control over and accept no responsibility for:

  • The accuracy, legality, quality, or condition of any listed item.
  • The ability of sellers to sell or buyers to buy.
  • Whether a transaction is completed or goes wrong.
  • Any losses, injuries, or damages arising from a transaction or interaction between users.
  • Animals or livestock dying in transit or after purchase.
  • Fraudulent, misleading, or illegal listings posted by users.

3. Your responsibilities as a user

By using FragSwipe, you agree to:

  • Provide accurate, truthful information in all listings.
  • Only list items you legally own and have the right to sell.
  • Not post illegal, offensive, fraudulent, or misleading content.
  • Not list protected or CITES-restricted species without valid permits.
  • Not harass, impersonate, or harm other users.
  • Take full responsibility for any deal you enter into with another user.

4. Limitation of liability

To the fullest extent permitted by South African law, FragSwipe, its owners, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform or any transaction made through it.

This includes but is not limited to: financial loss from a transaction, damage to equipment or livestock, personal injury, or data loss.

5. Content and listings

You retain ownership of content you post. By posting, you grant FragSwipe a non-exclusive, royalty-free licence to display your content on the platform. We reserve the right to remove any listing that violates these terms or applicable law, without notice.

6. Account termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

7. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

8. Changes to these terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
